Abstract

This review provides a brief overview of how the US regulatory environment affects the privacy of individuals. Building on this, two current Big Data issues are addressed: The first problem is that many companies and institutions that have access to useful data have few positive, sometimes even negative, incentives to disclose the source of such data , The second problem is that cooperative barriers between many data-holders prevent meaningful aggregation of data (eg, pooling), as long as policymakers understand these issues and their interrelations with the current framework of US law, it may be possible to find new political solutions to these problems.
